Acceptance of Terms

By accessing and using simlev.space ("the Platform"), you agree to be bound by these Terms of Service, our Privacy Policy, and any additional policies referenced herein. If you do not agree, you must not use the Platform.

Nature of the Services

Simlev is an online platform that connects clients seeking massage and wellness services with independent, qualified therapists. Simlev does not provide massage therapy services directly — all services are performed exclusively by independent Therapists who are not employees, agents, or representatives of Simlev.

Therapists' Requirements

To offer services on Simlev, Therapists must:

• Present valid diplomas, licenses, or certifications proving their professional qualification.
• Maintain an active professional liability insurance policy covering their practice.
• Hold the legal ability to issue invoices or official receipts.
• Provide truthful and accurate information during registration.

Simlev reserves the right to suspend or remove any Therapist who fails to meet these requirements or violates these Terms.

Users' Responsibilities

Clients using Simlev agree to:

• Provide accurate and complete health information through the health declaration form prior to booking.
• Consult with a medical professional before booking if they have conditions that may contraindicate massage therapy.
• Use the Platform only for lawful purposes and in good faith.
• Be at least 18 years of age, or have the explicit consent and supervision of a parent or legal guardian.

Simlev is not responsible for inaccurate, incomplete, or misleading information provided by users.

Booking & Payments

• Advance booking fee: A payment of 60 NIS is required to confirm your appointment. This fee serves as a commitment from both the client and the therapist to honour the scheduled session.
• Minimum advance notice: Treatments must be booked at least 2 hours before the requested time.
• Payment methods: We securely process payments via third-party providers (credit/debit cards, PayPal, Apple Pay, Google Pay, Bit). Simlev does not store card details.
• Subscription plans: The subscription fee covers the booking and reservation cost. The total treatment value considers that the booking fee (60 NIS standard, or the subscription rate) is deducted from the total, and the remaining balance must be paid directly to the therapist at the time of the session.
• Option A – Essential: 15 NIS/month — The first treatment each month is covered by the subscription. From the 2nd treatment onward, the standard 60 NIS booking fee applies.
• Option B – Plus: 30 NIS/month — Up to 3 treatments per month are covered by the subscription. From the 4th treatment onward, the standard 60 NIS booking fee applies.
• Option C – Unlimited: 40 NIS/month — Unlimited treatments with no booking fee limits. Order as many sessions as you wish through Simlev.
• Minimum commitment: All subscription plans (A, B and C) require a minimum commitment of 4 months.
• First-time subscription conversion: When subscribing for the first time, the 60 NIS booking fee the user would have paid is converted into subscription credit: Option A — 60 NIS covers the first 4 months (15 NIS × 4). Option B — 60 NIS covers the first 2 months (30 NIS × 2); the remaining 2 months of the minimum commitment are billed on the recurring billing date. Option C — Only 40 NIS is charged for the current month; the remaining 3 months of the minimum commitment are billed on the recurring billing date.
• Billing date: Recurring charges are processed on the same calendar day each month as the original subscription date.
• Subscriptions renew automatically each month.
• Full-price services: The full total treatment value is charged only through the “Make a Gift” feature and for corporate services (offices, events, etc.).

Cancellation & Refund Policy

Cancellation by the client:

• More than 48 hours before: Full refund of the booking fee.
• 24–48 hours before: 50% refund.
• Less than 24 hours before: No refund. Additionally, a charge of 90 NIS will be applied to the client's registered payment method to compensate the therapist for the lost appointment slot.
• No-show / personal cancellation: The booking fee covers administrative costs and the therapist's lost availability. No refund will be issued.

Cancellation by the therapist:

• In the event of a therapist cancellation, Simlev will assign another qualified therapist with equivalent knowledge and training for the requested treatment type as quickly as possible.
• The client will be notified promptly. If no suitable replacement is available within a reasonable time, a full refund of the booking fee will be issued.

Force majeure: In cases of serious illness, accident, or other significant reasons, the client may submit a written request to legal@simlev.space. Simlev will review each request on a case-by-case basis and inform the client of the final decision.

Health & Safety

Clients are required to complete a health declaration form before their first treatment. This information helps therapists provide safe and appropriate care. Simlev and its therapists reserve the right to decline a treatment if health conditions pose a risk. Clients are responsible for consulting with a medical professional if they have conditions that may contraindicate massage therapy.

Liability Disclaimer

Simlev is a platform intermediary and is not liable for:

• The outcome, effectiveness, side effects, or adverse reactions resulting from treatments provided by Therapists.
• Misconduct, negligence, or malpractice by Therapists.
• Injuries, allergic reactions, or health issues arising from services.
• Temporary unavailability of the Platform or technical issues caused by third-party providers.
• Booking errors or payment failures caused by third-party payment gateways.

All payments are processed by trusted third-party payment providers. Simlev is not liable for transaction failures or unauthorised charges caused by such providers.

Intellectual Property

All content on Simlev (text, images, design, trademarks, etc.) remains the property of Simlev or its licensors. Users may not copy, reproduce, or use any content without prior written consent.

Governing Law

These Terms are governed by the laws of the State of Israel. Disputes shall be resolved exclusively in the competent courts of Tel Aviv, Israel, unless otherwise required by applicable consumer protection laws.

Updates to Terms

Simlev may update these Terms periodically. Continued use of the Platform after updates constitutes acceptance of the revised Terms. Updates will be published on simlev.space.

בשימוש ב-simlev.space (ה"פלטפורמה"), המשתמש/ת מסכים/ה לתנאי השירות, מדיניות הפרטיות וכל מדיניות נוספות. אם אינך מסכים/ה, עליך להפסיק מידי להשתמש בפלטפורמה.

אופי השירותים

SimLev היא פלטפורמה מקוונת המחברת לקוחות עם מטפלים עצמאיים מקצועיים. SimLev אינה מספקת שירותי עיסוי יישירית — כל הטיפולים מבוצעים באופן בלעדי על ידי מטפלים עצמאיים, שאינם עובדי SimLev.

דרישות מהמטפלים

כדי להציע שירותים ב-SimLev, מטפלים חייבים:

• הצגת תעודות, רישיונות או הסמכות מקצועיות בתוקף.
• אחזקת פוליסת ביטוח אחריות מקצועית תקפה.
• יכולת חוקית להנפיק חשבוניות/קבלות רשמיות.
• מסירת מידע מדויק ואמיתי בעת הרשמה.

SimLev שומרת לעצמה את הזכות להשהות או להסיר כל מטפל שלא עמד בדרישות.

אחריות המשתמשים

לקוחות משתמשי SimLev מסכימים ל:

• מסירת מידע בריאותי מדויק ומלא בטופס הבריאות.
• התייעצות רפואית אם קיימת מגבלה שעלולה לסתיר את העיסוי.
• שימוש בפלטפורמה אך ורק למטרות חוקיות ובתום אמונה.
• גיל מינימלי 18 שנה.

הזמנות ותשלום

• דמי הזמנה: נדרש תשלום של 60 ₪ לאישור הפגישה. דמי ההזמנה משקפים התחייבות של שני הצדדים.
• זמן הזמנה מינימלי: יש להזמין טיפול לפחות 2 שעות לפני המועד המבוקש.
• אמצעי תשלום: התשלום מעובד באמצעות ספקי תשלום צד שלישי (כרטיסים, PayPal, Apple Pay, Google Pay, Bit). SimLev אינה שומרת פרטי כרטיס.
• מנויים: דמי המנוי מכסים את עלות ההזמנה. ערך הטיפול המלא מתחשב שדמי ההזמנה (60 ₪ רגיל, או תעריף המנוי) מנוכה מהסכום הכולל, והיתרה משולמת ישירות למטפל.
• אופציה A – Essential: 15 ₪/חודש — הטיפול הראשון בכל חודש מכוסה במנוי. מהטיפול ה-2 ואילך, דמי הזמנה הרגילים של 60 ₪ חלים.
• אופציה B – Plus: 30 ₪/חודש — עד 3 טיפולים בחודש מכוסים במנוי. מהטיפול ה-4 ואילך, דמי הזמנה הרגילים של 60 ₪ חלים.
• אופציה C – Unlimited: 40 ₪/חודש — טיפולים ללא הגבלה. הזמינו כמה טיפולים שתרצו דרך SimLev.
• התחייבות מינימלית: כל מסלולי המנוי (A, B ו-C) דורשים התחייבות מינימלית של 4 חודשים.
• המרת מנוי ראשונה: בעת הרשמה למנוי, 60 ₪ שהמשתמש היה משלם כדמי הזמנה מומרים לקרדיט מנוי: אופציה A — 60 ₪ מכסים 4 חודשים (15 ₪ × 4). אופציה B — 60 ₪ מכסים 2 חודשים (30 ₪ × 2); יתרת 2 החודשים יחויבו במועד החיוב החוזר. אופציה C — רק 40 ₪ יחויבו עבור החודש הנוכחי; 3 החודשים הנותרים יחויבו במועד החיוב החוזר.
• מועד חיוב: החיובים החוזרים מתבצעים באותו יום בחודש שבו בוצע המנוי המקורי.
• המנויים מתחדשים אוטומטית מדי חודש.
• שירותים במחיר מלא: ערך הטיפול המלא נגבה רק בשירות המתנות ובשירותים לעסקים (משרדים, אירועים וכדומה).

מדיניות ביטול והחזרות

ביטול על ידי הלקוח:

• מעל 48 שעות מראש: החזר מלא של דמי ההזמנה.
• 24–48 שעות: החזר חלקי של 50%.
• פחות מ-24 שעות: לא ייעש החזר. בנוסף, יחוייב סך הלקוח סך של 90 ₪ על אמצעי התשלום הרשום שלו, כפיצוי למטפל על איבוד התור.

ביטול על ידי המטפל:

• SimLev תשייך מטפל חלופי בעל אותה התמחצות והכשרה במהיר האפשרי ויודע ללקוח בהקדם האפשרי.
• אם לא נמצא תחליף בזמן סביר, יוחזר דמי ההזמנה במלואם.

כוח עליון: במקרים של מחלה חמורה, תאונה, או סיבות מהותיות אחרות, הלקוח רשאי להגיש בקשה בכתב אל legal@simlev.space. SimLev תבחן כל בקשה לגופה ו&#xx05EA;ודיע ללקוח את החלטה הסופית.

בריאות ובטיחות

הלקוחות נדרשים למלא הצהרת בריאות לפני הטיפול הראשון. המטפלים ו-SimLev שומרים לעצמם את הזכות לסרב טיפול אם קיימת סיכון בריאותי.

הגבלת אחריות

SimLev אינה אחראית ל:

• תוצאות, יעילות או תופעות לווי של הטיפולים.
• התנהגות פסולה או רשלנות של מטפלים.
• אי זמינות זמנית של הפלטפורמה או תקלות טכניות.

קניין רוחני

כל תכני SimLev (טקסט, עיצוב, סימנים וכו') הם רכוש של SimLev. אין להעתיק או להשתמש בתכנים ללא אישור בכתב.

דין וסמכות

תנאים אלו כפופים לדיני מדינת ישראל. הסכסות יתבררו בבית המשפט המצוין בתל אביב, ישראל.

En accédant à simlev.space (« la Plateforme »), vous acceptez les présentes Conditions d'utilisation, notre Politique de confidentialité et toute politique additionnelle. Si vous n'acceptez pas, vous ne devez pas utiliser la Plateforme.

Nature des services

Simlev est une plateforme qui met en relation des clients avec des thérapeutes indépendants qualifiés. Simlev ne fournit pas directement de services de massage — tous les soins sont réalisés exclusivement par des thérapeutes indépendants qui ne sont pas employés de Simlev.

Exigences pour les thérapeutes

Pour proposer des services sur Simlev, les thérapeutes doivent :

• Présenter des diplômes, licences ou certifications professionnels valides.
• Maintenir une assurance responsabilité professionnelle en vigueur.
• Détenir la capacité légale d'émettre des factures ou reçus officiels.
• Fournir des informations exactes lors de l'inscription.

Responsabilités des utilisateurs

• Fournir des informations médicales exactes et complètes dans le formulaire de santé.
• Consulter un médecin avant de réserver en cas de contre-indication possible.
• Utiliser la Plateforme à des fins légales et de bonne foi.
• Être âgé d'au moins 18 ans.

Réservation & paiement

• Frais de réservation : Un paiement de 60 NIS est requis pour confirmer votre rendez-vous. Ces frais témoignent de l’engagement mutuel du client et du thérapeute.
• Délai minimum : Les soins doivent être réservés au moins 2 heures avant l’heure souhaitée.
• Moyens de paiement : Paiement sécurisé via prestataires tiers (carte, PayPal, Apple Pay, Google Pay, Bit). Simlev ne conserve pas les données de carte.
• Abonnements : Les frais d’abonnement couvrent le coût de la réservation. La valeur totale du traitement tient compte du fait que les frais de réservation (60 NIS standard ou le tarif d’abonnement) sont déduits du total, et le solde restant doit être payé directement au thérapeute lors de la séance.
• Option A – Essential : 15 NIS/mois — Le premier traitement de chaque mois est couvert par l’abonnement. À partir du 2ème traitement, les frais de réservation standard de 60 NIS s’appliquent.
• Option B – Plus : 30 NIS/mois — Jusqu’à 3 traitements par mois couverts par l’abonnement. À partir du 4ème, les frais de réservation standard de 60 NIS s’appliquent.
• Option C – Unlimited : 40 NIS/mois — Traitements illimités sans restriction de frais de réservation. Commandez autant de séances que vous le souhaitez via Simlev.
• Engagement minimum : Tous les plans d’abonnement (A, B et C) nécessitent un engagement minimum de 4 mois.
• Conversion lors du premier abonnement : Les 60 NIS que l’utilisateur aurait payés en frais de réservation sont convertis en crédit d’abonnement : Option A — 60 NIS couvrent les 4 premiers mois (15 NIS × 4). Option B — 60 NIS couvrent les 2 premiers mois (30 NIS × 2) ; les 2 mois restants de l’engagement minimum seront facturés à la date de facturation récurrente. Option C — Seuls 40 NIS sont facturés pour le mois en cours ; les 3 mois restants seront facturés à la date de facturation récurrente.
• Date de facturation : Les prélèvements récurrents sont effectués le même jour calendaire chaque mois que la date d’abonnement initiale.
• Les abonnements se renouvellent automatiquement chaque mois.
• Services à tarif plein : La valeur totale du traitement est facturée uniquement via la fonction « Faire un Cadeau » et pour les services aux entreprises (bureaux, événements, etc.).

Politique d'annulation et de remboursement

Annulation par le client :

• Plus de 48 h avant : Remboursement intégral des frais de réservation.
• 24–48 h avant : Remboursement de 50 %.
• Moins de 24 h avant : Aucun remboursement. De plus, une somme de 90 NIS sera prélevée sur le moyen de paiement enregistré, à titre de compensation pour le créneau perdu par le thérapeute.

Annulation par le thérapeute :

• Simlev assignera dans les meilleurs délais un thérapeute de remplacement possédant les mêmes compétences et la même formation.
• Le client sera notifié rapidement. À défaut de remplacement, un remboursement intégral sera effectué.

Force majeure : En cas de maladie grave, d’accident ou d’autres raisons sérieuses, le client peut soumettre une demande écrite à legal@simlev.space. Simlev examinera chaque demande au cas par cas et informera le client de la décision finale.

Santé et sécurité

Les clients sont tenus de remplir un formulaire de déclaration de santé avant le premier soin. Simlev et ses thérapeutes se réservent le droit de refuser un soin si des conditions de santé présentent un risque.

Limitation de responsabilité

Simlev n'est pas responsable des résultats, effets indésirables ou blessures liés aux soins prodigués par les thérapeutes, ni des comportements fautifs de ces derniers, ni des indisponibilités techniques de la Plateforme.

Propriété intellectuelle

Tout le contenu de Simlev (textes, images, design, marques) reste la propriété de Simlev ou de ses concédants. Toute reproduction sans autorisation écrite est interdite.

Droit applicable

Ces Conditions sont régies par le droit israélien. Les litiges seront portés devant les tribunaux compétents de Tel Aviv, Israél.
